1. Agreement to Terms

Welcome to UnifiedNest. These Terms of Service ("Terms") constitute a legally binding agreement between you and me, Divakar (an individual developer), governing your use of UnifiedNest's family management applications and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

UnifiedNest includes three main components:

• Website: A marketing and informational website about UnifiedNest
• Blog: A platform for family articles, stories, and community content where registered users can publish articles, comment, and interact
• Mobile App: A shopping list and family organization tool (coming soon)
• Educational Games: Interactive learning games for children (available for users of all ages, coming soon)

3. Eligibility and Account Registration

3.1 Age Requirements

• Educational Games: Available for children of all ages with parental supervision recommended
• Main Services (Website & Mobile App): You must be at least 13 years old
• If you are under 18, you must have parental consent to use the main services
• Users under 13 are restricted to educational games only

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized use
• We reserve the right to suspend accounts for security reasons

4. User Conduct and Acceptable Use

4.1 Permitted Use

• Use the Service for personal, family organization purposes
• Share content only with authorized family members
• Respect the privacy and rights of other users

4.2 Prohibited Activities

You agree NOT to:

• Respect copyright and intellectual property rights

5.2 Blog Content and User Submissions

User-Generated Content License:

• By publishing articles, comments, or other content on our blog, you grant UnifiedNest a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content
• You retain ownership of your content
• You represent that you have all necessary rights to the content you publish
• You are solely responsible for your content and any consequences of publishing it

Content Moderation:

• We reserve the right to remove, edit, or refuse to publish any content at our discretion
• We may moderate comments, articles, and user profiles for policy violations
• Repeated violations may result in account suspension or termination
• We are not obligated to monitor all content but may do so

Comment Policy:

• Comments must be respectful and constructive
• No spam, self-promotion, or commercial content in comments
• Comments must be relevant to the article
• We may remove comments that violate these guidelines

Copyright and DMCA:

• We respect intellectual property rights
• If you believe content infringes your copyright, contact us at legal@unifiednest.com with:
  • Description of the copyrighted work
  • Location of the infringing content (URL)
  • Your contact information
  • A statement of good faith belief
  • A statement under penalty of perjury that the information is accurate
• We will investigate and take appropriate action, which may include removing content
• Repeat infringers may have their accounts terminated

5.3 Educational Content

Our educational games are provided as a non-profit service to support children's learning and development. These games:

• Contain no advertisements or monetization
• Do not track or collect user data
• Focus on educational value and skill development
• Are designed to complement, not replace, traditional education
• Encourage limited, purposeful device use for learning

Educational Disclaimer: While we strive to provide quality educational content, these games are supplementary tools only. They do not replace professional education, therapy, or parental guidance. Parents should supervise children's use and consult educational professionals for specific learning needs.

6. Intellectual Property Rights

6.1 Our Rights

• The Service and its content are protected by copyright, trademark, and other laws
• You may not copy, modify, or distribute our intellectual property
• UnifiedNest trademarks and branding are our exclusive property

6.2 Your Rights

• You retain ownership of content you create
• You grant us a limited license to store and display your content
• This license terminates when you delete your account

7. Payment Terms (Premium Features)

7.1 Billing

• Premium features require payment of applicable fees
• Fees are billed in advance on a recurring basis
• All fees are non-refundable except as required by law

7.2 Price Changes

• We may change pricing with 30 days notice
• Existing subscribers are grandfathered at current rates
• Price changes apply to new subscriptions only

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, and NON-INFRINGEMENT.

8.2 Third-Party Services Disclaimer

IMPORTANT: UnifiedNest relies on various third-party services for hosting, database, authentication, DNS, CDN, and other infrastructure. These include but are not limited to:

• Supabase: Database and authentication services
• Google Cloud Platform: Serverless backend services (Cloud Run/Cloud Functions)
• Vercel: Web hosting and deployment
• Google Analytics: Analytics and tracking
• Domain registrars and DNS providers: Domain management
• CDN providers: Content delivery
• Email service providers: Transactional emails

WE ARE NOT RESPONSIBLE FOR:

• Any changes, updates, or modifications made by third-party service providers to their services, terms, or policies
• Service interruptions, outages, or downtime caused by third-party providers
• Data breaches, security incidents, or unauthorized access occurring at third-party service providers
• Loss of data due to third-party service failures, bugs, or technical issues
• Changes in pricing, features, or availability of third-party services
• Any actions or omissions by third-party service providers
• Compliance issues arising from third-party services

While we take reasonable precautions in selecting and monitoring third-party service providers, we cannot control their operations, security practices, or business decisions. Users acknowledge that third-party services are governed by their own terms of service and privacy policies.

8.3 No Guarantees

• We do not guarantee uninterrupted service or availability
• We do not guarantee data will never be lost or corrupted
• Features may change, be discontinued, or become unavailable
• Third-party services may change or terminate without notice
• We do not guarantee compatibility with all devices or browsers
• We do not guarantee that the Service will meet your specific requirements
• We do not guarantee that all bugs or errors will be corrected

8.4 Security Disclaimer

While we implement reasonable security measures, NO INTERNET-BASED SERVICE IS COMPLETELY SECURE. We cannot guarantee that:

• Unauthorized access, hacking, or data breaches will never occur
• Third-party infrastructure providers will maintain perfect security
• Your data will be immune from cyberattacks or technical failures
• All security vulnerabilities will be identified and patched immediately

You acknowledge that you use the Service at your own risk and should maintain your own backups of important data.

8.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims shall not exceed the amount paid by you for the Service in the 12 months preceding the claim, or $100 USD, whichever is greater
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes but is not limited to: loss of profits, data, use, goodwill, or other intangible losses
• This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis
• This limitation applies even if we have been advised of the possibility of such damages

8.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, labor disputes, Internet or telecommunications failures, third-party service provider failures, cyberattacks, or any other events beyond our control.

8.7 User Indemnification

You agree to indemnify, defend, and hold harmless UnifiedNest, Divakar (developer), and our affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your use or misuse of the Service
• Content you submit, post, or transmit through the Service
• Your violation of any applicable laws or regulations

This indemnification obligation will survive termination of these Terms and your use of the Service.

9. Termination

9.1 By You

• You may terminate your account at any time
• Termination does not relieve you of obligations incurred before termination

• We may terminate or suspend your account for violations of these Terms
• We will provide notice when possible
• Termination is effective immediately
